- Online Poker Lawsuit Continues
One lawyer has
had enough of online video poker bans, and has decided to do something
about it. Lee Rousso has filed a lawsuit against the state of
Washington alleging that the online gambling laws that they have are
illegal and unconstitutional. He has a hearing set for September 21st
to have the case heard.
Rousso is not
only a lawyer in Washington, but he is also the Poker Players Alliance
rep for the state. He says that the state’s ban on poker is in direct
violation of the U.S. Constitution, and is seeking a declaratory
judgment that the Internet Gambling Ban (IGB) is unconstitutional. He
says that the state’s ban on online video poker violates the Commerce
Clause of the Constitution, and that they are discriminating against
other states.
He says that
since gambling, internet gambling, online video poker, etc. are all
legal in Washington, the fact that they are trying to keep their
residents from online gambling from other states forces them to only
use those online casinos that are located in their state. They say
that online poker rooms outside of the state are illegal, and hence
the conflict.
Rousso also
says that it also violates the clause in two other ways, because it
puts more of “a burden on interstate commerce…that is not offset by a
compelling state interest.” He says it also violates the laws that
have already been passed by the federal government in regards to
international treaties. Not only that, but the penalty for playing
online video poker a Class C felony, which is the same classification
for child pornography or threatening the governor.
