- Video Poker No Matter What You Call It
The North Carolina state legislature is kicking themselves for not
being clearer about what constitutes an illegal video poker game, as
many are taking liberties with what they say are legal games. The
state says that any game that looks and works like a video poker
machine is illegal per law, but some are saying that it just isn’t
that clear.
The fact remains that every day more and more video poker games are
appearing across the state, and depending on where they crop up they
are not facing any sort of prosecution. The Guilford County District
Attorney’s Office says that the video poker machines do not fall under
the categories described by the law.
However, the government says that they do. They say that video poker,
slot machines, bingo, craps, etc. are all illegal – and the law states
that those machines that are "based on or involving the random or
chance matching of different pictures, words, numbers, or symbols not
dependent on the skill or dexterity of the player" are illegal.
But the law also adds that these video poker and slot machines are
illegal if they use a coin or token, credit or debit card, etc. –
basically any kind of currency for it to play. The new machines use
phone cards, which would make them a form of currency, so even there
they are covered under the law making them illegal.
However, as in Guilford County, they are turning a blind eye to the
machines and allowing them to run. They say that the law just isn’t
clear enough, but one has to wonder how they could get any clearer.
