Marvin Marty Babb is in hot water with the government for running an
illegal video poker ring. Investigators claim that Babb is responsible
for finding locations for Henderson Amusement Co’s illegal video poker
machines and has been indicted on six counts stemming from the
charges.
Babb has agreed to work with the government and will testify for them
in a plea deal that he worked out with them. He is expected to testify
regarding the two Buncombe County Sheriff’s deputies on his payroll.
Babb is looking at ten years in jail as well as a half a million
dollars in fines related to the charges of grand jury perjury and
conspiracy to run an illegal gambling operation. He will plead guilty
to both.
Babb is not alone in the mess, seven more people have been indicted as
well; he is just the first one to agree to testify. In return for his
testimony, the government has agreed to drop charges including
conspiracy to commit witness tampering and conspiracy to obstruct
justice. The arrests come after a two year investigation that was
spearheaded by the FBI in conjunction with the North Carolina Alcohol
Law Enforcement, the IRS and local officials in three different
counties.
The Henderson Company has made in excess of $5 million over the past
seven years in the state off of the video poker machines. The video
poker machines were illegal because they made cash payouts and they
have been illegal since July 1st. A total of 21 people have been
indicted in the case so far.
